Overview
There are some restrictions on what types of real estate a foreign national can own in Malta. Generally speaking, a foreign national is able to buy one piece of residential property that will be used as that persons primary residence or that will be used by that person as a holiday residence during part of the year.
With this in mind, an individual foreign national is not able as a general rule to buy commercial or industrial real estate in Malta. There are some instances in which a foreign national will join with citizens of Malta to form a joint legal venture -- usually in the form of a limited liability company -- to by non-residential real estate. It is important to keep in mind that this type of arrangement does require approval from different governmental agencies in Malta.
Even for EU member state nationals (Malta is now a part of the European Union) the ability to own real estate in the country is limited at this point in time. There is some natural and necessary movement to relax different real estate laws in regard to foreign nationals in the future to bring Malta more inline with the open market concept that is the centerpiece of EU membership.
Investment Real Estate
As has been set forth previously, there are some pretty stark limitations on what type of real estate a foreign national can purchase in Malta. With this in mind, the opportunities for investment in real estate -- beyond the ownership of a primary residence or a holiday home -- by a foreign national are limited.
Again, and as was discussed, there are some instances in which a foreign national will join together with citizens of Malta, to develop a legal entity that will take possession of real estate in that country for investment purposes. Even with this noted, the number of foreign nationals who are involved in such a venture is not significant due to the hurdles that must be surmounted in order to win governmental approval and authorization to purchase real estate beyond a residence.
There may be some relaxation in the laws governing investing in real estate by foreign nationals who are from European Union nations in the future. Of course, the concept behind the EU is to allow for a free economic flow between member nations. Thus, with Malta now a part of the EU, it is likely that there will be changes in its real estate laws as they same pertain to investment in different types of real estate in the country by citizens from other European Union nations.
Residential Real Estate - Single Family Dwellings
Generally speaking, it is only residential real estate that can be purchased at this time by foreign nationals in Malta. Although Malta has joined the European Union, where there can be found a broader ability of foreign nationals who are from EU member countries to by real estate within the EU, this barrier has not been fully surmounted in Malta.
The primary reason that there is a heavier restriction on foreign investment in real estate arises from the fact that there is, indeed, only a limited amount of real property available to sale within the borders of that country. Unlike many other nations, that still have undeveloped frontiers and a significant amount of space still available for development, such is not the case with Malta.
A foreign national, with relative ease, can make the purchase of one piece of residential real estate -- either to be used as a private and personal residence or as a holiday home. This will be discussed in greater detail shortly.
Many Europeans have purchased larger homes in Malta that have become favored second residences, holiday homes. A foreign national can stay within Malta for a period of up to three months at a stretch with no tax consequences or special filing requirements. A foreign national can spend between three to six months in consecutive succession in Malta with permission of the government. Generally, there will be no additional tax consequences on a foreign national in Malta until that person remains in country for a period beyond six months.
Residential Real Estate - Apartments
Upscale apartments remain attractive choices for foreign nationals looking to purchase real estate in Malta. As will be discussed shortly, a foreign national can make the purchase of residential real estate in Malta provided the property is valued at $50,000 MLT (the Maltese national currency) as is to be used only as private primary residence or as a holiday home by the purchaser.
These apartments -- high end apartments -- are in significant demand by foreign nationals at this point in time. These people, who enjoy spending part of the year in Malta (with its idyllic climate and easy lifestyle) are attracted to these apartments.
Vacation Real Estate
With its nearly perfect climate the entire year around, Malta has long been a favored travel destination for men and women from different countries around the world. The trend has continued unabated into the present day and age.
As a consequence, there is a growing number of foreign nationals who are interested in finding real estate to purchase in that country for holiday or vacation purposes. Indeed, as will be discussed shortly, there are general limitations on the ability of a foreign national to purchase real estate in Malta, generally restricting these men and women to being able to purchase one piece of residential property that can be used as a holiday home or as a permanent residence.

Specific Steps to Buying Real Property in Malta
Despite the fact that the real estate purchase process in Malta is a relatively easy process, there are some definite restrictions that apply to foreign nationals who are interested in purchasing real estate in Malta.
Generally speaking, a foreign national can purchase a residence in Malta that is going to be used either as a holiday home or a that purchasers primary residence into the future. In addition to this general restriction, there are some more specific requirements when it comes to a foreign national investing in real estate in Malta.
First of all, the value of the real estate that is being purchased must not be less than 50,000 MLT (the national currency in Malta). Second, all of the funds that are used to purchase this real estate must be derived from outside of the country. Third, the real estate that is purchased cannot be rented out to anyone else. This includes property that is purchased for occupancy as a holiday home during only part of the year. Unlike in many other countries around the world, a foreign national buying such a residence in Malta cannot lease out the property to someone else when it is not in use by the purchaser and owner. There is one interesting exception to this prohibition. The owner of a residence with a pool can, in fact, lease or rent out the property to someone else when he or she is not utilizing the property for his or her personal benefit.
Finally, on resale, a foreign national can repatriate the funds generated from the sale to his or her own country of origin.
Once these restrictions are appreciated and understood, the actual process of buying and selling real estate in Latvia is simple. The initial phase involves the execution of a contract for sale. At this time, the buyer is obliged to post a deposit that normally is in the amount of 10% of the overall purchase price of the real estate.
The preliminary agreement normally is valid for a period of three months. During this time period, the purchaser will obtain financing and the seller will make sure that there are no defects associated with the title that will prevent a clear conveyance of the property to the purchaser when the sale is concluded.
The final contract ultimately is entered into between the parties. It is at this time that the buyer pays the remaining balance due and owing on the property. Additionally, it is at this juncture that the buyer will take physical possession of the real estate.
There is some effort in Malta at the present time to relax at least to some degree (and most likely for residents of other EU member nations) the real estate laws in that country. Most of the proposals that are being considered center on allowing foreign nationals a bit broader usage with their residential property. For example, there are proposed laws being considered that would allow a person who owns a holiday home or residence in Malta the ability to rent or lease that property to someone else during those times of the year when the owner is not personally utilizing the real estate in question. Again, any such changes more than likely will be targeted towards citizens from EU member nations.

Almost 20 years ago, I began researching the Ouija Board to see if there was any validity or proof that could be gained from it that would benefit us all. At the time, I have to say that, like most people, I too had been deeply influenced by rumours that such devices are evil, not to be trusted or, at the very least, questionable. It was after a ponderous and shaky start that, after a lot of patience, three people already passed over, one after the other, dropped in to speak to me. And although they provided me with enough proof of their existence to sink a battleship yet, it still wasnt quite enough for my mind to accept that I was actually speaking to real people from beyond the grave. However, with Debbie all of this was to change.
Is there anyone there? I asked. On my old board now The Spirit Contact Board© (which is far superior) the usual responses were slow in forming. But, as I say, with a little patience, it soon made sense when the board replied:
DEBBIE
Hello Debbie. I said, What can we do for you?
PASS THE DOPE
Pardon? Did you say pass the dope Debbie?
YES
What dope are you talking about? We dont have dope in this house.
At the time, Marijuana was very much outlawed and, with two young children in the house, such chemicals and the sure problems with Police that were bound to follow, was not permitted anywhere near my family or my home. However, the reply to this remark was:
YOU DO
Even if this were to be true, in my mind, there could be only one reason that there was any kind of outlawed drug in my home back then and that would have to be that someone around the table had got some and hadnt said so. Other than this, there was no chance of their being any kind of this type of drug in the home. So I asked,
Ok. You say that there is dope in this house. Could you tell me where it is please?
UNDER CHAIR
Oh right. Under a chair. Im sorry Debbie but I think youre mistaken. There isnt any dope under any chair in this house Ok?
THERE IS
I then asked everyone around the table if they had any dope and that, if they had then to please own up and put an end to this. But there was no need to ask for they all felt the same as me about it.
As you can see Debbie at least, I think you can no one here has got any dope. So, if they havent got any then, how can there be any under any chair? Are you sure youre not pulling my leg?
NO. DOPE UNDER CHAIR
I was getting rather bored with this so I sighed and asked, Ok. Which chair is it under please?
Although I have mentioned that there were eight people around that board that night yet I must add that as they were sat yet I was stood at the back taking notes and that, my finger was never on that glass.
CHAIR NEAR YOU
You mean this one on my left?
YES
Youre joking! Theres no way that theres any dope under that chair. No one sits in it but me Debbie and I dont use the stuff. Ok. Dont bother answering that. Let me check and prove you wrong Ok?
OK. TRY
I will!
With that, I put down my notes and moved the chair.
Now, in being a lazy couple back then, neither my wife nor myself ever vacuumed under either chair. Like a lot of people, we hovered around them to then get on with other things like watching TV etc. So, when I moved the chair and, much to our embarrassment, there was almost enough dust and debris there that could have coated a bald Bear! In any event, in ignoring our red faces, I bent down and started to sift through it to show Debbie and everyone else that there wasnt a hope of her being right.
But, to my utter incredulity, she was!
When I had finished sifting through all the rubbish, right there, in my fingertips was a small rolled up piece of silver paper. Inside this foil was a small piece of dope that must have been there I dont know how long.
How on EARTH did you know this Debbie!? I exclaimed.
FELL OUT OF (A name I cant mention) POCKET
Well I never! I cant believe my own eyes here! Look everyone! Tell me this isnt dope! But, when they all looked at it, they all recognised that it indeed was. Unbelievable! How could this have anything to do with any ideomotor effect? How could any of us have ever thought of pushing the glass around even unconsciously - to spell out something so very far fetched as this? Dope? In MY house? Never! To make matters even more incredulous, the person she mentioned hadnt set foot in my house for over twelve months prior to this communication!
Was this proof enough for us? Of course it was. But the story didnt end there for; we had yet even more shocking news and proof - to come from Debbie that continued on until the early hours of that night. Further information revealed But wait; there is something you need to know first.
At that time, I was in the habit of going around to a friends house on Tuesday nights for what we called Computer Nights. It was back in the Commodore 64 days before most of us even thought of owning a PC. As far as the general public was concerned, such masterful multi-tasking machines had yet to be invented. Now, I dont know if youre the same as me but, for me, although I may make a friend yet, unless the topic is brought up, rarely will I come to know if he or she has any brothers or sisters. And, with him being the same with me, he didnt know this about me either. However, unbeknownst to my friend, I had some shocking news in wait that would turn him right over when I saw him the following Tuesday.
It was as we were sat playing that I brought up the subject of family. After I had told him of mine, I asked him about his to which his reply was that he had had two sisters.
What do you mean by had two sisters D?
Oh? Didnt you know? I lost one a few years back.
Really? Ok. Can I try something with you?
Whats that?
You know that I didnt know you had any family until I asked you didnt you?
Yeah? So what?
OK. Supposing I fill in the gaps for you? If I do that then, will you believe me that my board works and that the afterlife really does exist after all?
He laughed and said, You can try if you like but it wont do you any good.
Oh dont let that worry you. Ok. Lets start at the beginning. You havent told me yet but Im going to tell you that the sister you had, was named Debbie. Is that right?
He was drinking from a can at the time and nearly spilled the lot when, ashen-faced, he turned to me and yelled, How did you know that!?
Let me finish Ok? Im right arent I? So, let me think now. How did she die? Well, Ill tell you. She was hitching a ride to London in which she managed to hitch a ride from a truck driver. Since the truck driver didnt get his wicked way, he threw her out of his truck. As you and I now both know, like your older sister Helen who is still with us - Debbie liked her drugs didnt she? She liked Heroin. So, when the truck driver threw her out, he had no idea that she was as high as a kite. Anyway, he was in such a temper about not getting his way that he stopped the truck immediately. Without even thinking about it, he had inadvertently thrown her out on the fast lane. Since Debbie wasnt at all sober, she wondered around that lane not knowing what she was doing. Moments later, a fast car came and drove over her killing her outright. When she died, Debbie was 18. Is there anything Ive said D that was wrong?
My friend was at a complete loss as to what to say or do. He didnt say a word to me for over an hour and was at a complete loss for words. By the look on his face, I knew that everything I had just said was true and that no detail was wrong. In any event, when he did manage to gain control of himself, he verified every word.
Two weeks later, in knowing I was still up, he phoned me at two in the morning and he was crying. When I asked him what the matter was (he doesnt cry) it took him everything to tell me that, since our conversation, he had been overcome with the loss of Debbie. He went on to add that, when she had been so tragically killed like this, his whole family, parents and all, had all but blocked it from their minds. Although they had a funeral for her and all had turned up yet, for them, such a thing hadnt really happened. They told themselves that, since Debbie always hitched everywhere that, this is where she is out there somewhere, still alive and having too much fun to come home. At that point, he begged me to drive him to her grave.
When we eventually found the graveyard in the dead of night in a small village nearby, it was dark, cold and very foggy. For over an hour and, with lighters in hand, he and I searched amongst the gravestones for where she could be. When we found her, he threw himself on her grave, held her headstone and sobbed his heart out.
I loved you Debbie. Im sorry I wasnt much of a brother to you. But I loved you. Im sorry. So sorry Im so sorry for everything...
As he cried and released his obvious deep remorse and, although I didnt view myself as being particularly psychic at the time yet, I swear I could feel Debbie holding him very tightly indeed as she cried along with him.
It was beautiful.
And, after such a good start that continued for the next 20 years, how many more adventures like this do you think I've had? How much more proof was given in that time. So much.
